1. Acceptance

By accessing or using SELQIK.com ("Platform") you agree to these Terms of Use, our Privacy Policy, Data & Compliance Policy and IP Infringement Policy. If you do not agree, do not use the Platform.

2. Eligibility

You must be 18+ and legally able to enter contracts in your jurisdiction. Sellers must provide accurate KYC information when requested.

3. Account Responsibility

You are responsible for all activity under your account. Keep credentials confidential. Notify us immediately at support@selqik.com for unauthorized access.

4. Sell Types Are Legally Binding

Full Rights = one buyer only, forever. Selling Full Rights to multiple buyers is fraud. Rental = time-limited, multi-buyer allowed. Lease = usage rights only, no transfer. Auction = highest bidder wins. All types enforced via escrow and permanently recorded.

5. Escrow Required

All transactions must use SELQIK secure escrow. Off-platform payments void buyer protection and SELQIK cannot assist with external disputes.

6. Prohibited Listings

No illegal, stolen, infringing, harmful, hateful, sexual, weapons, regulated drugs, financial scams, malware, or content violating any law of India or the buyer's country.

7. Robot Listings

Sellers must provide condition report and operational video before approval. Buyer has 7-day hardware-fault return window. Seller bears return shipping for verified faults.

8. AI Content

AI-generated content is allowed. Sellers must disclose AI nature and own/have rights to sell. Original creators receive verified badge.

9. Fees

Listing is free. Escrow fee 3%. Optional paid plans. All fees shown before payment. No hidden charges.

10. Suspension & Termination

We may suspend or terminate accounts for fraud, abuse, repeated infringement, or breach of these Terms. Pending escrow funds will be refunded to affected buyers.

11. Disclaimers

Platform is provided "as is". SELQIK is an intermediary under Section 79 of the Information Technology Act, 2000. We do not guarantee uninterrupted service or specific outcomes from purchases.

12. Limitation of Liability

To the maximum extent permitted by law, SELQIK's aggregate liability is limited to fees paid by you to SELQIK in the 3 months preceding the claim.

13. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Courts at Chennai, Tamil Nadu have exclusive jurisdiction.

14. Changes

We may update these Terms. Continued use after changes constitutes acceptance.

1. Who We Are

SELQIK.com is operated from Chennai, India. We are the data fiduciary for personal data you provide while using the Platform.

2. Data We Collect

Account info (name, email, phone), KYC (when required for sellers), listing content, transaction & escrow records, device/browser/IP, cookies, and support communications.

3. How We Use It

To operate listings and escrow, verify identity, prevent fraud, process payments via Razorpay, send transactional emails, comply with law, and improve the Platform.

4. Legal Basis

Contract performance, consent (for marketing), legitimate interest (fraud prevention, security), and legal obligations under Indian law.

5. Contact Privacy

Your phone and email are never shown publicly. Contact details are revealed to the counterparty only after escrow is confirmed.

6. Storage & Processors

Database: Supabase. Images: Cloudinary. Payments: Razorpay. Email: Resend. Hosting: Cloudflare. Data may be processed outside India under appropriate safeguards.

7. Retention

Account data: while active + 3 years. Transaction & sell-type agreements: 7 years for legal/tax compliance. KYC: as required by law.

8. Sharing

Never sold. Shared only with: payment processors, escrow partners, law enforcement (on valid legal request), and counterparties post-escrow.

9. Your Rights (DPDP Act, 2023)

Access, correction, erasure, grievance redressal, and withdrawal of consent. Email support@selqik.com; requests processed within 48 hours.

10. Cookies

We use essential cookies for sessions and analytics cookies for product improvement. You can disable cookies in your browser; some features may break.

11. Children

The Platform is not intended for users under 18. We do not knowingly collect data from minors.

12. Security

Encryption in transit (TLS), Row-Level Security on database, hashed passwords, and least-privilege access. No system is 100% secure — report issues to security@selqik.com.

1. Regulatory Framework

SELQIK complies with: Information Technology Act, 2000 (incl. Intermediary Guidelines 2021), Digital Personal Data Protection Act, 2023 (India), Consumer Protection (E-Commerce) Rules 2020, GST laws, and applicable RBI guidelines for payment aggregators (via Razorpay).

2. Intermediary Status

SELQIK acts as an intermediary under Section 79 of the IT Act. Listings, content and transactions are between buyer and seller. We are not party to the underlying sale.

3. KYC & Seller Verification

Sellers transacting above thresholds, or in regulated categories (robots, high-value AI agents), must complete KYC: PAN, government ID and bank/UPI verification. We may collect GSTIN for businesses.

4. Payments & Escrow

Payments are processed by Razorpay, an RBI-licensed Payment Aggregator. Escrow balances are held in a nodal/escrow account and released only on delivery confirmation or dispute resolution.

5. Data Localization

Payment data is stored in India per RBI guidelines. Personal data of Indian users is primarily stored in Indian/regional data centers; cross-border transfers happen only with safeguards permitted under the DPDP Act.

6. Tax Compliance

GST is collected on platform fees where applicable. Sellers are responsible for their own income tax and GST on the goods/services they sell. We issue invoices for platform fees.

7. Records & Audit

Sell-type agreements, escrow events and dispute logs are retained for 7 years and may be produced to regulators or courts under valid legal process.

8. Law Enforcement Requests

We respond to lawful requests from Indian authorities. Requests must be issued under appropriate provisions of CrPC/IT Act and sent to legal@selqik.com.

10. Data Breach Notification

In the event of a personal data breach, we will notify the Data Protection Board of India and affected users without undue delay, as required under the DPDP Act.

11. Cross-Border Users

Buyers/sellers outside India remain subject to Indian law and these policies. Local taxes and import duties are the user's responsibility.

1. Zero Tolerance

SELQIK respects intellectual property. Listings that infringe copyrights, trademarks, patents, trade secrets or publicity rights are strictly prohibited and will be removed.

2. Seller Warranties

By listing on SELQIK, sellers warrant that they own or have full rights to sell the item (including AI models, datasets, courses, images, code, agents and robots) and to grant the rights described in the chosen Sell Type.

3. AI-Generated Content

Sellers must disclose AI-generated material and ensure training data and outputs do not infringe third-party rights. Direct copies or close derivatives of protected works are prohibited.

4. How to File a Takedown Notice

Rights holders or authorized agents may submit a notice to ip@selqik.com with:

• Your full name, address, phone and email
• Description of the protected work and proof of ownership (registration no., URL, etc.)
• URL(s) of the infringing listing(s) on SELQIK
• Statement of good-faith belief that the use is unauthorized
• Statement, under penalty of perjury, that the information is accurate and you are authorized to act
• Physical or electronic signature

5. Our Response

Valid notices acknowledged within 24 hours. Infringing listings are taken down within 36 hours (per IT Rules 2021). The seller is notified and given an opportunity to respond.

6. Counter-Notice

If a seller believes a takedown was wrongful, they may submit a counter-notice to ip@selqik.com with identifying details, a statement under penalty of perjury, and consent to jurisdiction of courts in Chennai, India.

7. Repeat Infringers

Sellers with multiple confirmed infringements will be permanently banned. Escrow funds for infringing transactions will be refunded to buyers.

8. Trademark Misuse

Do not use third-party brand names, logos, or look-alikes in titles, descriptions or thumbnails without authorization. Comparative references must be factual and non-misleading.

9. False Notices

Filing a false or abusive infringement notice may result in liability for damages and account termination.
